What Will Chapter 7 Bankruptcy Do for Me?

Chapter 7 bankruptcy is designed to provide relief from crushing debt by discharging it. This form of bankruptcy addresses debt that is not associated with property or an asset, making it a good alternative for individuals who have a lot of credit card debt, unpaid medical bills, utility bills and similar debt.

If you qualify and choose to file a Chapter 7 bankruptcy, you will experience immediate benefits: It will stop harassing phone calls from creditors, lawsuits, repossessions and garnishments. The court issues an automatic stay, which prohibits your creditors from contacting you or attempting to collect a debt. When you have successfully completed the Chapter 7 process, your applicable debts will be discharged and you will have a fresh start.

Will I Be Able to Keep My Car and Home?

In a Chapter 7 bankruptcy filing, you agree to identify all of your assets. This does not mean that most or all of your assets will be sold by the trustee appointed by the court to handle your case. In fact, most if not all of my clients have no assets that are actually sold. Certain items of personal property, including your home, your car and other items, may be exempt from liquidation under the Bankruptcy Code. If you have to give something up, we will work together to reach the best result for you.

A Chapter 7 filing is not appropriate or desirable for everyone.
