What Doesn't Work

When you are getting harassing phone calls or someone is threatening to take your car, you might get desperate to fend off aggressive creditors. Some clients believe that if they continue to make nominal payments on a debt, even if it is just five dollars a month, the creditor will leave them alone. Unfortunately, that is not true.
Other clients, who were desperate to pay their bills, have elected to borrow money from another source in order to make their payments. This can be a very dangerous and damaging choice. You should never take money out of your home or your retirement to pay a bill without first speaking to an experienced bankruptcy lawyer.

What Does Work

First, if creditors or collectors are threatening you or using abusive language to get you to send payments, you do not need to tolerate their behavior. I often counsel individuals to use firm language during calls with debt collectors. For example, you can use phrases such as:

"I'm thinking about filing for bankruptcy. Please give me time to speak with a lawyer and do not call me about this matter again."
"Your phone calls have a threatening tone. I am keeping a diary of the dates on which you called and the things you have said to me. If I find that they crossed over the line, I may take legal action against you."

Of course, these are only temporary measures. They will buy you enough time to contact me and to get a more solid plan of action in place to prevent wage garnishment or repossession.
